CDA VACATION RENTALS SHORT TERM RENTAL AGREEMENT
CDA Vacation Rentals LLC
208-819-1717 | support@cdavacationrentals.com
This Short Term Rental Agreement is between CDA Vacation Rentals LLC, acting as property manager for the owner (Host), and the guest identified in the reservation to which this agreement is attached (Guest). The property, arrival and departure dates, approved occupants, rate, payment schedule and cancellation policy are those shown in Guest's reservation confirmation and any approved written amendments. Those reservation terms are incorporated into this agreement and govern the stay; they do not need to be entered separately here. Cancellation deadlines, refund eligibility and any cancellation charges follow the cancellation policy disclosed and accepted for that reservation at booking.
1) RESERVATION TERMS AND ACCEPTANCE
This agreement applies to the entire reservation and everyone Guest invites or allows onto the property. Guest must be legally able to contract, provide accurate identification and contact information, remain an occupant unless Host approves otherwise in writing, and ensure all occupants and visitors receive and follow these rules. Guest is responsible for their conduct and resulting damage to the extent permitted by law.
The property-specific rules, pet restrictions, occupancy limits, parking instructions, amenity restrictions, shared-area disclosures and other material conditions supplied and accepted before booking form part of this agreement. Mandatory law controls. For a booking made through a third party, applicable booking-channel terms control to the extent they require. Otherwise, a specific accepted reservation or property term controls over a general term here. Later operational instructions may explain existing rules or address immediate safety hazards; new material restrictions or charges require agreement or another lawful process.
This agreement will be available through a link on Host's website for review before booking. Guest must electronically sign this agreement before the scheduled check-in time, including any approved early check-in. If Guest fails to sign by that deadline, Host will cancel the reservation at Guest's expense, with cancellation charges and any refund determined by the cancellation policy disclosed and accepted at booking and mandatory law. Access will not be provided before signing. Host will disclose this signing requirement and its cancellation consequences before booking. The electronic signature records Guest's acceptance; it does not make previously undisclosed terms binding retroactively. No term waives a nonwaivable legal right.
2) AUTHORIZED OCCUPANCY AND ACCESS
The property is offered solely as temporary vacation and recreational lodging for personal enjoyment, relaxation and leisure during the approved reservation dates. It is not offered as permanent housing, a primary residence or an ongoing place to live. Guest agrees to this limited purpose and may not use the property as a permanent residence or represent it as such. The reservation permits occupancy only for the approved dates and occupants; it does not include a right to remain beyond those dates. Extensions require Host's prior written approval. These permitted uses do not authorize parties, events or gatherings prohibited by this agreement. Do not exceed the approved guest count, maximum occupancy, or any disclosed limit on total persons on site. All overnight occupants must be included in the reservation. Daytime visitors require prior written approval unless the accepted property rules expressly allow them. Guest must ensure unauthorized visitors leave when directed.
No subletting, assignment, resale, transfer of the reservation, or sharing access with unapproved people is permitted. Commercial events, ticketed activities and use as an event venue require advance written approval. Keep access codes private and doors secure. Report missing keys, compromised codes and unauthorized entry promptly. Do not enter locked, owner-only, storage, maintenance or other excluded areas.
This reservation is for a fixed period of temporary lodging and does not automatically renew or promise continued occupancy. The parties intend a temporary vacation accommodation arrangement rather than an ongoing residential tenancy. Legal occupancy status and any tenant protections depend on law and the actual circumstances, including the nature and length of the stay; the stated purpose of this agreement and Guest's signature do not eliminate protections that apply.
3) CHECK IN AND CHECK OUT
Check-in is 4:00 PM on the arrival date and checkout is 10:00 AM on the departure date, in the property's local time, unless Host expressly approves a different time in writing. A planned arrival or departure time entered on a check-in form does not change these times.
Early check-in, late checkout and additional nights require written approval and payment of any fee disclosed before booking or accepted when the optional service is purchased. Availability is not guaranteed. A pending request, Host's silence or an attempted payment is not approval. All occupants and visitors must leave, belongings must be removed and access devices returned by the applicable lawful departure deadline.
4) PARTIES NOISE AND CONDUCT
Parties, unauthorized events, open-invitation gatherings and disruptive gatherings are prohibited at all times. Party behavior includes disruptive amplified music, shouting, repeated disruptive arrivals, dangerous or unlawful conduct, or use of the property as a gathering venue beyond the approved reservation. Remaining within maximum occupancy does not authorize a party. These restrictions apply during daytime and evening hours as well as quiet hours.
Observe the quiet hours stated in the accepted property rules. If no different quiet hours were disclosed, quiet hours are 10:00 PM to 8:00 AM. Keep noise reasonable at all times, including outdoors, in parking areas and in shared spaces. Stop disruptive conduct promptly when notified. Threats, intimidation, harassment, violence and interference with neighbors, other guests, owners, vendors or staff are prohibited.
5) SMOKING PETS AND PROPERTY SAFETY
Smoking and vaping are prohibited inside accommodations and in shared interior spaces. Outdoor smoking is allowed only in an area expressly designated in the accepted property rules. If no area is designated, smoking and vaping are prohibited throughout the property. Do not smoke near open doors or windows or leave smoking waste on the property.
Pets are permitted only at designated pet-friendly properties, with prior approval, registration on the reservation and payment of the disclosed pet fee. Follow the property's species, number, size, supervision and waste restrictions. Permission to bring a dog does not authorize cats, rodents or other animals. Guest is responsible for animal-related damage and extraordinary cleaning as permitted by law. Service and other assistance animals are handled under applicable law and required booking-channel policies; ordinary pet fees and restrictions do not override required accommodations.
No illegal activity, fireworks, unsafe fires, dangerous misuse of amenities, blocked exits, or tampering with locks, smoke detectors, carbon monoxide detectors, alarms or properly disclosed monitoring devices. Follow all accepted parking, trash, fire, water, amenity and community rules. Report malfunctioning equipment instead of disabling it.
6) HOUSE RULE VIOLATIONS AND TERMINATION
Guest and everyone Guest admits must comply with every provision of this agreement and all incorporated property rules. Failure to comply is a breach. Host may require the conduct to stop, require unauthorized visitors to leave, seek lawful documented charges and terminate the stay for a material violation or a repeated violation after notice. Any legally required notice and opportunity to cure will be provided.
Parties or disruptive gatherings, dangerous overcrowding, violence or credible threats, intentional or substantial damage, unlawful activity, material reservation fraud, serious safety violations and interference with safety equipment are material breaches. Host may terminate the stay immediately upon notice to the extent permitted by law. No courtesy warning is required before acting on a serious violation, except for any mandatory notice or opportunity to cure. Host must have a reasonable factual basis for the violation.
Host may terminate permission to occupy for grounds stated in this agreement regardless of the booking channel, subject to law and binding channel terms. Host need not wait for a booking channel to cancel before exercising a contractual termination right. If a channel cancels the remaining stay, Host may issue a corresponding termination and departure notice consistent with that cancellation and applicable law.
The termination notice will identify the reservation and property, the reason, the effective termination time and the required departure date and time. Guest must stop the prohibited conduct immediately. When occupancy lawfully ends, Guest must ensure all occupants and visitors leave, remove personal belongings, return access devices and surrender possession by the stated lawful deadline. Any longer mandatory notice period or court process controls. Guest must not return without written authorization or other lawful authority.
A refund dispute, appeal, pending complaint or assessed overstay charge does not by itself extend a lawfully terminated stay. Host may request law enforcement assistance or pursue lawful possession proceedings. This agreement does not authorize unlawful force, lockouts, utility shutoffs, seizure of belongings or bypassing required notices or court proceedings. Access codes may be deactivated after possession is lawfully recovered or when otherwise expressly permitted by law.
To the extent permitted by law and binding channel terms, termination caused by Guest's material breach does not entitle Guest to a refund for unused nights. Host may retain only legally recoverable amounts and must honor required refund, mitigation and accounting duties. Termination does not eliminate responsibility for proven damage or other lawful charges. Host will not collect twice for the same loss.
7) PAYMENTS CANCELLATIONS AND REFUNDS
Guest must pay the amounts due under the payment schedule shown in the reservation confirmation. All mandatory booking fees are bundled into the rate shown for the reservation; applicable taxes and the total amount payable are shown in the booking total before payment. Any separately disclosed refundable security deposit is not a booking fee. Optional services selected by Guest and lawful charges arising from damage, overstays or rule violations are additional only as disclosed and authorized under this agreement or separately agreed in writing. Cancellation deadlines, cancellation charges, refunds, no-shows and voluntary early departure follow the cancellation policy disclosed and accepted at booking for Guest's reservation, subject to mandatory law and applicable channel policies. The dates and cancellation policy on the reservation confirmation control without requiring a separate reservation-specific agreement. Cancellation requests must be made through the original booking channel or, for direct bookings, in writing to Host.
All refunds, including reservation refunds and refundable security-deposit balances, are subject to applicable nonrefundable payment-processing fees actually charged by the card processing company in connection with the original payment or its refund, but only to the extent disclosed and agreed before booking or deposit collection and permitted by law and binding payment or booking-channel rules. These fees are typically 3.9% of the applicable card payment; the actual fee may vary by processor and transaction. This is not an automatic 3.9% cancellation charge or an additional Host administrative fee. Host will deduct only the actual applicable processing cost that the processor does not return or waive, will not recover the same cost twice, and will identify any deduction in the refund breakdown. No processing-fee deduction will be made where a full refund without deductions is required by law or binding payment or booking-channel rules. Any different applicable fee or calculation must be disclosed before Guest agrees to the payment.
Failure to pay, a failed or reversed payment, or material false booking information may justify cancellation or termination after required notice. Host will communicate payment issues and follow law and channel procedures. A good-faith billing dispute alone does not establish fraud.
If the reserved accommodation becomes unavailable for reasons not caused by Guest, Host will promptly notify Guest and attempt to arrange relocation to an alternative property that Guest approves, or offer a refund of all amounts paid to Host for the reservation, less only any processing-fee deduction permitted under the refund-processing provision above. Guest is not required to accept an alternative property. If no alternative is approved, Host will provide that refund, subject only to the permitted processing-fee deduction described above. Any alternative property's price and terms require Guest's approval before relocation. Mandatory law and binding channel terms continue to apply. Weather, travel disruption and service outages that do not make the reserved accommodation unavailable are addressed under the accepted cancellation policy, applicable law and channel policies. Travel insurance is recommended but optional.
8) OVERSTAYS DAMAGE AND ADDITIONAL CHARGES
An unauthorized departure after checkout may result in the $100 late checkout charge if disclosed before booking and legally enforceable. Paying or being assessed this amount does not purchase additional time or create an extension. Guest may also be responsible for reasonable documented additional losses caused by an overstay to the extent legally recoverable, with overlapping amounts credited.
Where disclosed before booking and legally enforceable, smoking or vaping violations may result in a $500 remediation charge, and failure to remove pet waste may result in a $100 removal charge. These are intended as reasonable recovery amounts, not punishment. No charge gives permission to continue a violation. If a fixed amount is unenforceable, Host may seek recoverable documented actual costs instead. Additional costs may be claimed only to the extent not already covered by an assessed amount.
Guest is responsible for reasonable documented costs caused by Guest or Guest's party, including damage beyond ordinary wear, missing items, extraordinary cleaning, smoke or animal remediation, and necessary replacement of lost access devices. Ordinary turnover cleaning is included in the reservation rate. Guest is not responsible for preexisting damage or losses outside Guest's responsibility. Host will provide an itemized claim and supporting evidence and account for depreciation where required.
For direct bookings, charges for agreed services and documented amounts properly due must comply with the agreed payment authorization, payment rules and law. Host will provide itemized notice before additional damage charges and a reasonable opportunity to respond. Channel bookings must follow the channel's required claims and collection process. No prohibited off-platform charge is authorized. Guest retains lawful billing, chargeback and dispute rights, and Host may provide truthful supporting evidence.
A security deposit or card hold applies only if its amount and terms were disclosed and agreed. If a refundable security deposit is collected, Host will initiate the refund of the remaining balance within 10 business days after checkout and surrender of the property, or sooner if required by law. Any lawful deductions will be accompanied by an itemized statement. Bank and payment-processor processing times may vary, so the date funds appear in Guest's account may be later than the date Host initiates the refund. Processing delays do not extend any mandatory legal deadline. A card authorization hold, if used instead of a collected deposit, will be submitted for release within the same period; bank processing times may vary. A deposit or platform protection program is not a cap on proven liability. Host will credit payments from Guest, deposits, insurers and channels to avoid duplicate recovery for the same loss. Attorney fees and recovery costs may be claimed only where legally authorized and allowed through the applicable process.
9) PROPERTY CARE REPORTING AND ENTRY
Use the property responsibly and leave it reasonably tidy according to the disclosed checkout instructions. Promptly report damage, leaks, safety concerns, pests, missing items and service problems to Host at 208-819-1717. Report arrival concerns as soon as reasonably possible, preferably within 24 hours. This request does not waive claims for later-discovered defects, legal remedies or channel claim deadlines. Take reasonable safe steps to prevent avoidable additional damage.
Allow Host a reasonable opportunity to investigate and remedy reported problems when safe and legally appropriate. Host, the owner and authorized personnel may enter for emergencies, necessary repairs, safety checks or documented rule concerns only as permitted by law and with any required notice. Advance notice will be provided for nonemergency entry where reasonably practicable. Any shared spaces, owner access or excluded areas must be disclosed in the accepted property rules and do not authorize unrestricted access to private guest areas.
10) AMENITIES BELONGINGS AND PRIVACY
Use hot tubs, fitness equipment, docks, bicycles, watercraft and other amenities according to their disclosed safety rules, age restrictions and supervision requirements. Do not use equipment while impaired or allow unsupervised children near water. Wear properly fitted life jackets when required by law or amenity rules. Stop using damaged equipment and report it. Guest accepts ordinary inherent recreational risks to the extent permitted by law. Nothing here excuses Host's safety or maintenance duties or waives liability that cannot lawfully be waived.
Host does not guarantee uninterrupted utilities, internet, weather or third-party services but will take reasonable steps to address reported failures. Guest should secure valuables and check for belongings before departure. Found or left property will be handled under applicable notice, storage and disposition requirements, not an automatic forfeiture rule. Returns may be arranged at Guest's agreed shipping cost. Liability for loss remains subject to law.
Security cameras and monitoring devices must be specifically disclosed before booking as required by law and channel policy. No interior security cameras are authorized. Permitted exterior devices must respect reasonable privacy expectations. Disclosed noise monitors measure sound levels rather than record conversations. Guest must not disable, cover or tamper with permitted devices.
Host uses personal information to administer the reservation, provide support, document incidents and comply with law. Information may be shared as reasonably necessary with authorized service providers, the booking channel, insurers, legal advisers or authorities, consistent with privacy requirements. Host does not sell guest personal information. Marketing permission is optional, separate from signing this agreement and may be withdrawn.
11) RESPONSIBILITY LAW AND NOTICES
To the extent permitted by law, Guest is responsible for third-party claims and reasonable associated costs to the extent caused by Guest's or Guest's party's negligent, intentional or unlawful acts or material breach. Guest is not required to indemnify Host or the owner for their own negligence, gross negligence, willful misconduct, statutory violations or liability that cannot lawfully be shifted.
Idaho law governs, subject to federal law. Unless mandatory law or a binding channel dispute provision requires otherwise, court proceedings concerning the property or this agreement will be brought in a court with jurisdiction in Kootenai County, Idaho. This agreement does not independently impose arbitration, waive a jury trial or prevent use of an available small claims court.
Guest must maintain working contact details and reasonably monitor reservation messages. Operational and contractual notices may be communicated through the booking channel, email, text or in person. Host should use available duplicate methods for urgent notices. These methods do not replace legally required service or notice periods. Contact Host at 208-819-1717 or support@cdavacationrentals.com. For emergencies, contact emergency services first.
An unenforceable provision does not invalidate the lawful remainder. A one-time exception or delay does not waive future enforcement, subject to law. No provision permits unlawful discrimination, retaliation, restrictions on honest reviews or waiver of nonwaivable rights. Material amendments require written agreement or another lawful process. This agreement and the accepted reservation and incorporated rules comprise the agreement for the stay, subject to applicable channel terms. This version does not retroactively amend an earlier signed agreement.
